Mike Morris 6/11/2019 I would like to request the Charter Contract between LPSD and Monument Academy providing for the establishment of their school (Elementary School through High School). I am looking for all established Charter rules. 0.25 6/13/2019 Mr. Morris,
The Monument Academy Charter Contract can be found in Board docs at https://go.boarddocs.com under the March 15, 2018 – Board Discussion/Action  Items  C. 6.
I am uncertain of your request for “all established Charter rules.”  Chartering rules and law are Colorado  state rule and law.

    Bob Foster
Mike Morris 6/11/2019 According tot the agreement for the purchase of land sale to Matt Dunston under additional provisions, it specifically states that D38 shall receive official communication from Monument Academy that it has entered into an agreement with Matt Dunston and he has agreed to donate the land. I would like a copy of what was provided to D-38. It appears according to documentation that a Memorandum of Understanding may have existed at the time between Matt and Gene Dunston on 1 Aug 2018 0.25 6/13/2019 Mr. Morris,

Monument Academy has not sent LPSD any such MOU as of the date of this request. Another CORA request just sent contains the record of a previous MOU in August.
    Regards,

    Bob Foster
Mike Morris 6/11/2019 At the meeting tonight, it was stated by Taylor that there was a provision that land owner build a school. The contract that I read between D38 and Matt Dunston for sale of the land does not state that - instead it states that there needs to be a MOU - which currently does not exist. I would like to request the MOU at time of the deal, and where to find the specific provision that a school needs to be built. 0.25 6/13/2019 Mr. Morris,
The Monument Academy Charter Contract can be found in Board docs at https://go.boarddocs.com under the August 20, 2018 – Board Discussion/Action  Items  D. 5.

    Mr Foster,
It appears that Kelly Kempf Mobley is such an avid supporter of anything D38 on social media , many in the community are wondering actually how much D38 is paying her. Please provide me with anything that shows how much money she receives from D38. W2's, Contracts , invoices , check payments and even all benefits she receives from D38, since July 1 2018 to June 30 2019.  At the Same time please give the same info for other boosters like Cindy Coleman Waldmann, And Suzanne Magerko. Many want to know how much taxpayer money is going to these avid supporters .
    Thank you

Mike Morris 7/1/2019 It is my understanding that on May 3rd 2018, Matt Dunston emailed Karen Brofft a letter of intent to purchase the land at 83 and 105. Could I please have a copy of that letter of intent that was sent to Karen Brofft? Was there also a letter of intent from David Roy? If so, can I please have a copy of that as well? 1.00

    Thank you Robert.

In this document, there is a bullet point that states "D38 decision: From the “Right of First Refusal” document sent to MA, acknowledges that “The District has determined that it does not need said land to build a school or facility, and intends to sell the land…”"

Can I have that document that D38 apparently sent to Monument Academy?

    1.00 7/11/2019

    Mr. Morris,
A "First Right of Refusal" was not presented to Monument Academy. The intention to sell the land was presented in a Special Board Meeting on September 27, 2018, and those documents can be found under that meeting in BoardDocs.

    Mr . Foster ,
I would like the detail that shows the math for the computation of the $1266.77 and the $1266.67 amounts . There must be supporting documentation for these numbers as well as all the other nunbers on the spreadsheet .
    Thank you.
    Derek Araje

    .5 8/19/2019 Mr. Araje
As stated in your original email this portion of the document was a spreadsheet prior to being imbedded as a table in a PDF. The $1266.77 and the $1266.67 amounts are derived by multiplying the Total Mill Levy times the Assessed Value.
As stated in the text box “Stated Mills and Assessed value as certified Dec. 3, 2018 and contained in supporting documentation from El Paso County.” The mills and amounts were certified and can be found in the December 3, 2018 Board meeting on Boarddocs.

    Dear Sir,
I was thrilled with news that Lewis-Palmer District 38 School Board adopting a “Resolution to Refuse” to implement the new Colorado HB-1032 Sex Ed Standards. Many parents are appalled with this “radical sex education curriculum” and many parents remain unaware of it and how it is effecting our children.
I went to the District 38 Page but I saw there was no audio or video released as yet. I was hoping you might be able to provide me with a copy of the written “resolution” for my perusal, and for the possibility of sharing it within my parents Facebook group, “Colorado Parents for Education Options”. So many of us have driven to the state capital to testify against this and many other bills last legislative session.
Again, any help you can offer with getting a copy of the actual “Resolution to Refuse” that was voted on last night at the BOE meeting I would really appreciate it!

     Derek Araje 9/24/2019

    Mr Foster ,

I dont know if this needs to be a CORA request or not , but to be safe, I sent it as one. I would like to arrange a time to come into the office and have a spot ( conference room ) to review the hard copy architectural plans for the proposed new school as prepared for D38 by CRP. Pleae let me know what time works well to do this.

     .5  9/26/2019

    Mr. Araje,

The architectural plans are not in paper format and thus could not be inspected in that manner. Also, as these plans include details of the building that are considered as security features they may not be shared under C.R.S. 24-72-104 (2)(a)(VIII)(A) as this would provide “detailed design information.”

However, if you were able to provide specificity as to which aspect of the facility you were inquiring about a release of specific portion of the plans or redacted portion may be possible

    Regards

    Bob Foster

    Derek Araje 9/27/2019

Measurements of each and every room . I genuinely dont think you got $1.5 million of plans . This is why I want to see them . I am happy to come In to see them on the computer. I want some documented plans . Let's start with this . How about the electrical plans. heating and cooling plans , the footprint of the building as positioned on the property , the measurements of each and every room..I dont believe detailed plans exist for this building . I think they were never completed after the bond failed last year
So I want to see what D38 got for $1.5 million from CRP. This is not an unreasonable request . Why should they have spent the time completing plans for a building that my never be build ? Make sense ?

     Mike Morris 10/1/2019

I would like to CORA any and all communications from Scott Saunders to D38 personnel, specifically in regards to GraceBest. More specifically, I am looking for email communications of a meeting that took place and the pertinent communications should include the following individuals Matt Dunston, Chris Taylor and Matt Clawson.

Can I add an additional CORA to this request?

May I have a couple of any communications that have taken place regarding the Districts land at 83 and Hodgen?

    1) I would like to request the appraisal of land that was conducted prior to the sale of the property at 83/105. I have never seen an appraisal of that land to D38. If in email format, please include the complete email header of the originated email from the sender to whomever the recipient was. If in document format, please include the original Modified, Access, Creation, and Entry (MACE times) of the document.

    2) Second, during the meeting today, we discussed that Matt Dunston submitted two proposals for that land. Can I please have a copy of both of those submissions\proposals? If in email format, please include the complete email header of the originated email from Matt to whomever the recipient was. If in document format, please include the original Modified, Access, Creation, and Entry (MACE times) of the document.

3.) Similarly, I have heard rumant that there was a proposal that fell through earlier in that same year - may I please have that proposal - assuming one actually exists? If in email format, please include the complete email header of the originated email from sender to whomever the recipient was. If in document format, please include the original Modified, Access, Creation, and Entry (MACE times) of the document.

4.) During our meeting today, you mentioned that you coordinated with Monument Academy (MA) (and Matt Dunston?) regarding the apparent $3M that was passed to Monument Infrastructure (Matt Dunston & Walden Corporation). As you will recall, $1.5M of that money is specifically addressed in the MA bond with D.A. Davidson for the sale of land - 42 acres of land (23 acres to be transferred back and 19 acres to remain for MA). The second $1.5M appears to be a separate declared contract for another $1.5M for actual water and sewage infrastructure. I would like to request a copy of the correspondences that transpired between you, your counsel, and MA (and/or Matt Dunston). If none exists via written communication, then I would like D38 to request and provide through their Charter Agreement of MA - a copy of the agreements between MA Infrastructure and MA Foundation. Specifically, the MA Bond calls out two transactions: 1.) a land purchase 2.) a “developer contract” for preparing the infrastructure.

     1.00 10/3/2019 Mr. Morris,

    Response

It is estimated the two requests above will take approximately an additional four hours to complete and cost approximately $120. Checks may be made payable to LPSD and the search will begin on payment. Production of emails would be three to four days from receipt of funds.

The document that has been retained is attached.

    My response

These proposals were part of a negotiation were part of a negotiation protected by attorney-client privilege. The outcome and record of these negotiations is the land sale record that is maintained by the district. I believe you already have this contract.

There is no record that matches this request.

The second $1.5M appears to be a separate declared contract for another $1.5M for actual water and sewage infrastructure. Specifically, the MA Bond calls out two transactions: 1.) a land purchase 2.) a “developer contract” for preparing the infrastructure.

To clarify, my comment was that I had contact with the president of MA’s Board, Mr. McWilliams, as well as Matt Dunston. They confirmed, independently, that the $1.5M was not considered money for the land sale by them, rather it was for infrastructure. There was no correspondence.

The request of records “through their Charter Agreement of MA - a copy of the agreements between MA Infrastructure and MA Foundation. Specifically, the MA Bond calls out two transactions: 1.) a land purchase 2.) a “developer contract” for preparing the infrastructure.” is not a request for records created and maintained by the District.

While not covered by CORA this request will be reviewed for with District Counsel regarding the District’s ability to do so regarding these entities.

    Regards

    Bob Foster
